Terms and Conditions

Object of agreement
The following terms and conditions applies only for order and transport of goods wich the customer have bought at Bodyboarder-shop.de. The Institution is Bodyboarder.de Inh. Alexis Karantinas.

Prevalance of terms and conditions
Within of this benefits there are the following terms and conditions considered.

Conclusion of contract
All offers from Bodyboarder.de Inh. Alexis Karantinas are subject to change. The contract between the customer and Bodyboarder.de Inh. Alexis Karantinas finally stays with with assignment through the customer and whose acceptance through Bodyboarder.de Inh. Alexis Karantinas. The order of the customer occur online by using the order formular on the online shop from Bodyboarder.de Inh. Alexis Karantinas. Bodyboarder.de Inh. Alexis Karantinas accepts the order by sending a written confirmation to the customer or by sending the ordered goods.

Delivery
1.Except when otherwise stipulated the delivery follows on Store Budenheim or one of the suppliers.
2.From Bodyboarder.de Inh. Alexis Karantinas called respites and deadlines are unsealed. Bodyboarder.de Inh. Alexis Karantinas is anxious to deliver goods in 6 business days (foreign 12 business days) after incoming payments. Is an order not available after 2 weeks from ordering the customer could cancel his order, except when otherwise stipulated.
3.Should the customer refuse the delivery Bodyboarder.de Inh. Alexis Karantinas hve the choice to cancel the contract or to sue for payment. Bodyboarder.de Inh. Alexis Karantinas could determine the damage to 10% of the order without any commission. The customer has to demonstrate that Bodyboarder.de Inh. Alexis Karantinas has not received any damage by his refuse.
4.The Bodyboards are not color-coordinated, the board which has delivered will not be the some color like shown in the shop. The picture in shop is only for demonstration purpose. Please indicate your color preference when you place your order or ask via email befor ordering!

Conditional sales contract
Bodyboarder.de Inh. Alexis Karantinas reserves the proprietary rights until the customer has paid the whole price for his order.

Donation / Shipping costs
1.The purchase price will be payable by ordering.
2.The customer could pay via cash on delivery or advance.
3.Delivery in germany will be charged with delivery costs up from 4,90 €. Depending on amount and weight.
4.Delivery in the EU will be charged between 16 - 41 €. This depends by amount and weight.
5.The Customer has to pay all kind of additional bank transfer cost´s. Also the fee for the exchange rate.
6.The amount for cash on delivery is 7 €, this includes 2 € postal service.

Charging
The customer could only get charging, if this are legally binding or was not contested by Bodyboarder.de Inh. Alexis Karantinas. The right of retention is only allowed for requirements of the named contractual relationship.

Delay
Is the customer in default with his payment he will be charged for interest about 3% over base rate from the European Central Bank. The customer also has to demonstrate that Bodyboarder.de Inh. Alexis Karantinas has only a small or non damage. Bodyboarder.de Inh. Alexis Karantinas reserves for further requirements.

Warranty and Commitment
1.The warranty complys to the statutory provisions, if not different arranged.
2.Is any fault on the object within the warranty, the customer firstly could demand a recification of defects. If the second recification missed it´s not further expect to the customer, so he could choose to get back the amount or get a contraction.
3.Bodyboarder.de Inh. Alexis Karantinas only be liable for damage to property, which not belongs to the bought object himself, by deliberate and careless attitude.
4.In Case of common or basic careless Bodyboarder.de Inh. Alexis Karantinas only be liable for damage to property by injury of so called cardinal obligation. The liability behaves only to the typical damage for breach of contract. Liability for damages not covered by this agreement is excluded.
5.As far as the commitment of Bodyboarder.de Inh. Alexis Karantinas is excluded or limited, this also includes the commitment of all persons which could be assigned to Bodyboarder.de Inh. Alexis Karantinas.
6.For damages in transit the transport company is liable for all risks, not Bodyboarder.de Inh. Alexis Karantinas. Please check your order directly after arrival. Claims should be announced directly to the transport company or to Bodyboarder.de Inh. Alexis Karantinas by email.
7.Rules and regulations by law are inviolated.

Right of Withdrawal
1.The Customer could revoke his offer to buy within 2 weeks. Bodyboarder.de Inh. Alexis Karantinas will not separate point the customer to this right of withdrawal.
2.A withdrawal is excluded, if the delivery has closed within 14 days after ordering. Also by delivery of audio and video or software, which has been unsealed by the customer. Also by goods which are unqualified for reshipment, or perishable.

Sale or return
Bodyboarder.de Inh. Alexis Karantinas acknowledge the customer to return the good within 2 weeks, if the customer didn´t satisfy to his order. Withdrawal is excluded by delivery of audio and video or software, which has been unsealed by the customer. The costs for reshipment will be payed by Bodyboarder.de Inh. Alexis Karantinas with a amount of 5.90€ (DHL online service). Unstamped returns will be accepted, but the additional costs would be charged to the customer! We please you only to send goods with adequate stamps. By returns with value less then 40€ the customer has to pay the shipment costs.

Privacy
Personal data of customer would only be collected within the statutory provisions of the German Data Protection Act (BDSG). Further processing for marketing purposes are only for the sending newsletters if the customer accept this by registration. Also this website use Google Analytics for web usage measure. Personal data will never be given to a third company, as long it´s not neccessary for transport, or the BDSG.

Final clause
1.If one or more arrangements of this Terms and Conditions are effectless, this would not get the whole contract effectless. The effectless part will be displaced by the actual law.
2.This contract appliance to german law only to the exclusion of Uniform Law on the International Sale of Goods (CISG).
3.Place of venue and delivery is Mainz, except when otherwise stipulated
